Program Terms & Conditions

Next Level Fitness Academy – the Fit Squad Referral Program (“Program”) allows Customers to earn a referral gift (“Referral Gift”) by referring friends and family that enroll in an online coaching program with Next Level Fitness Academy, Inc. (“Next Level”).

By participating in the Program, you agree to abide by these Referral Program Terms & Conditions.

Definitions

Referrer: you, a legal resident of the continental United States

Referred Customer: a friend or family member who has not previously signed with Next Level’s online coaching program and to whom the Referrer makes an introduction on behalf of.

Referral Gift: a promotional merchandise item to be emailed or mailed to you. Referral Gifts are while supplies last, and may be swapped out per Next Level Fitness Academy’s discretion for a similar product of equal value.

How to Earn a Referral Gift: To qualify for a Referral Gift, you must (i) refer only valid Referred Customers (ii) complete your preferred gift selection questionnaire (iii) provide accurate shipping and contact information at the time of opt-in.

For each contracted referral, you will receive a gift valued up to $150. Gifts are at the discretion of the Next Level Fitness Academy and are subject to change due to availability.

Gifts will be shipped 4-6 weeks after an executed contract is finalized and Referred Customer has started their coaching program.

Referral Gift Exclusions: Each Referral Gift is non-transferable, not valid for cash or cash equivalent, and cannot be combined with other offers. Referral Gifts are not able to be returned or refunded for cash, credit, or future purchases.

Qualifying Referral Programs: All Referred Customers must execute a signed contract for one-on-one personal coaching with Next Level in a regularly priced 3, 6 or 12 month program capacity and either pay the contract fee in full, or sign a monthly payment installment contract with a third-party lender upon agreement. The Next Level 21 Day Kickstarter, online or in-person bootcamp programs, or nutrition-only packages do not qualify for Referral Gifts. Discounted program enrollments are ineligible for referral gifts; this may include but is not limited to scholarship-funded enrollments, or special promotional details as detailed by Next Level at the time of the promotion. Referees must be new clients to Next Level and may not have participated in any prior programs, bootcamps, or special events to be considered eligible.

How to Receive Your Referral Discount: To qualify for a Referral Discount, you must be introduced to Next Level from the Referrer by means of group text, group chat on a social media platform, via an email conversation, or noted on the client application. If the Referred Customer does not get introduced to Next Level from a Referrer, Referred Customer will not be eligible for a Referral Discount. All eligible Referred Customers will receive up to $500 off the total Fee of the contractual service agreement, based upon the length of signed, full-service program as outlined in the Qualifying Referral Program section. The Referral Discount will be notated in your final service agreement and payment arrangement and is not to be used in place of a program deposit or payment installment. Referees must be new clients to Next Level and may not have participated in any prior programs, bootcamps, or special events to be considered eligible for the referral discount.

Notwithstanding anything to the contrary contained in this Agreement, if Next Level is delayed or prevented from complying with the Agreement or providing Referral Gifts, either totally or in part, by reason of fire, flood, storm, strike, acts, omissions, any law, order, proclamation, regulation, ordinance, demand, seizure or requirement of any governmental authority, riot, civil commotion, war, rebellion, act of terrorism, nuclear or other accident, explosion, casualty, disease, pandemics, epidemics, or act of God, or act, omission or delay in acting by any governmental or military authority or third party or any other cause, whether or not of a class or kind listed in this sentence, beyond the reasonable control and without the fault of Next Level (each, a “Force Majeure Event”), then upon notice to the Referrer, the affected provisions and/or other requirements of this Agreement shall be suspended during the period of such Force Majeure Event and Next Level shall have no liability to the Referrer, or any other third party in connection therewith, and Next Level shall have the right to terminate this Agreement by virtue of a Force Majeure Event; provided that Next Level shall use all commercially reasonable efforts to perform its obligations as soon as possible.

Termination

Next Level may suspend or terminate the Program or a Referrer’s ability to participate in it at any time for any reason. We reserve the right to review and investigate all referral activities and to suspend accounts or modify referrals in our sole discretion as deemed fair and appropriate.

Eligibility

Eligibility is limited to current and past Next Level clients, and individuals over the age of 18. Next Level’s employees are eligible to introduce Referred Customers, however, employees will not earn any Referrals Gifts.

Privacy

By opting in to the Program, the Referrer understands that any personal information collected, processed, and used as part of the Program, including that of the Referrer and Referred Customer, will be used in accordance with Next Level’s Privacy Policy.

Next Level is not responsible for errors, omissions, malfunctions, interruptions, deletions, delays or failures of operations and shipment of Referral Gifts. Next Level reserves the right to close the account(s) of any Referrer and/or Referred Customer and to request proper payment if the Referrer and/or Referred Customer attempts to use the the Program in a questionable manner or breaches any of these Terms & Conditions or is in violation of any law, statute or governmental regulation. All of Next Level’s decisions are final and binding, including decisions as to whether a Discount is verified.

A Referred Customer may only be referred by one Referrer. If a Referred Customer receives referrals from multiple Referrers, only the Referrer with the first introduction and a completed consultation call within 90 days will be eligible for a Referral Gift. Referrers, however, are eligible to refer multiple eligible Referred Customers.

Next Level reserves the right to cancel the Program or to change these Terms & Conditions at any time in its sole discretion without prior notice. The Program is subject to modification at any time without notice at Next Level’s sole discretion. Continued participation in the Program after any modification shall constitute consent to such modification.
